37:22And this is what they're trying to cover up. And this is coming. And so uh this is the in ' 94 to 96 and Poli founded ID Models and meet Slovenia model Melania Krauss in Milan on a casting call.

57:07over the country. Spain has been terrible, Trump told reporters in March, adding that he requested the Treasury Secretary Scott Pessent to cut off all dealings with the country. 57:53Spanish Prime Minister Pedro Sanchez called on the European Union to suspend its treaty. His contempt for life and international law is intolerable, Sanchez wrote on Twitter. Here it is.

After writing the 2018 one-man play Sex and Circumcision, an American love story, he was terminated from Harvard University, prompting a lawsuit in a career shift into law and activism. A sumakum loud graduate of Colgate University with a degree in physics and economics, Klopper now represents clients in employment law, free speech, and civil liberties.

65:40Welcome to the show, Eric Clapper. Oh, well, thank you, Jimmy, for having me.

65:44I'm very uh pleased to be on the show.

65:46And as you mentioned, right now, my focus, at least in activism, is to protect every child equally from the harms of genital cutting, which primarily circumcision because that's still something that America struggles with, right? Although, >> but what first led you to research and speak out against infant male circumcision, especially your you you're Jewish, right? You have a Jewish background. I I I do have a Jewish background. So, I grew up as a Jewish American. And so, I I got it from both angles in terms of growing up in a genital cutting culture. You know, Americans cut their boys genitals and so

66:22does Jewish culture. And I, you know, always thought it was normal and it was healthy and, you know, that's what you do. Um, and then when I, uh, was playing on a rugby tour abroad, there was, you know, a fair amount of nudity and in that tour, drinking, you name it. And uh I remember seeing all these intact or uncircumcised Scots and I was thinking, "Okay, well, what's going on here? These penises look radically different from all the penises I've seen growing up."

66:52And I just started to look into it. And the more I looked into it, the worse it got. And it got essentially I discovered that it started, at least in the religious sense, because rabbis wanted to blunt the sexual organ of of their boys and their men, right? uh so they would focus more on let's say uh divine pursuits and the study of the Torah instead of you know satisfying those lascivious urges right and when you look at the actual anatomy it's very clear that the foreskin is a highly evolved structure over millions of years that has most of the erogynous tissue an article was just published saying that

67:33the male G-spot is actually the frenular delta which is under the head of the penis which is not surprising. It's the most sensitive part of every male. And so it's uh really damaging. And then I got into a really bitter dispute with my Jewish father over the propriety of my own circumcision. And I'm thinking, you have no idea what you're talking about.

67:52This is extremely harmful. I've I've experienced it myself. You can watch a child be circumcised. They'll scream their heads off. Some have actually burst their lungs and their stomachs from screaming so loud. It is one of the most painful experiences that men or individuals will experience in their whole life. And we're subjecting it to infants, defenseless infants. And if who if we don't speak for infants, who will, right? And so it is one of those rare issues in our, you know, culture where everyone can get behind it. It's just a matter of education and knowing what's going on, which is why I, uh, greatly

68:29appreciate you having me on the show to, you know, help enlighten your viewers.

68:34So, I've been thinking about this topic a lot lately also uh last few years and there is is there any therapeutic reason to circumcise?

68:47>> Well, it started in America about a hundred years ago and the medical reason for it was it made it more difficult for children to masturbate, right? And that was seen as the root cause of all illnesses and it was also seen as immoral, right? Against God's wishes.

69:05So, it actually started as a puritanical anti-masturbation uh uh kind of trend in the US because we have a for-profit health care system. It incentivizes procedures even if they're medically unnecessary. Um but no, if you look at the broader kind of numbers of sexually transmitted diseases, America has a higher per capita STD rates than the European nations that don't circumcise. And you could get into the biomechanics and as to why that is, why that isn't. Um but the fact that it has any medical benefit is just a meme. It's been it's been repeated so many times that people think it's true. But when

69:45you actually look under the hood, you realize, you know, I guess pun intended, um, that it's actually just damaging a very functional and normal body part and it impairs the ability for people to self-pleasure and have sex and nobody wants that. So, we should just protect our children and stop mutilating their sex organs. But no, there's no medical uh benefit and there's not a single secular medical organization in the world who advocates for it. And in fact, every single medical organization in the world advocates against it with the exception of the American American Academy of Pediatrics, which used to

70:25issue a very lukewarm recommendation which they retracted in 2017 because it's indefensible to recommend a medically unnecessary amputation on a child. Right. So they just there's no opinion in America. Yeah. So they don't recommend it anymore, even lukewarmly.

70:45>> No. In 2012, they issued this 27page uh uh and I go for 40 minutes in my Harvard presentation on how it's it's deceptive, but it's a 27page statement that concludes that the benefits of circumcision outweigh the risks uh enough that health care insurers should reimburse the procedure. So they're not saying that you should do it, but they're saying you should keep paying for it because this is a multi-billion dollar industry, right? The actual removal of the tissue and then selling the children's harvested genital tissues to various biomedical companies to put in skin care creams and burn victims and

71:27all that stuff.

71:28>> No kidding.

71:30>> Yeah, this is big business.

71:32>> So it so it's complete bunk when they say it reduces sexually transmitted diseases, right? So there there there really isn't there is no medical benefit to doing this. Yet they keep doing this because we live in a for-profit medical industry and that's why they're really doing it. Right.

71:50>> Yeah. Hospitals it's it's so it's regional like you know I'm suing the state of Oregon to stop on constitutional grounds but Oregon has like a 25% circumcision rate whereas some states in the Midwest still have like 80%. But if you look even break down the data more, it's you look around the hospital, hospitals have certain policies and they've done studies that uh some newborn mothers or some new mothers or expectant mothers are asked eight to nine times in labor whether or not they're going to circumcise their child, right? And there is a hospital policy to push this because the hospital gets probably 1 to 2,000 per procedure.

72:28Um the urologist gets paid. it gets often build to the taxpayers. So, we're using our tax dollars to mutilate our children. So, it's um it's really uh I think it's money uh driven right now in the US. And it's also culture because it the number one indicator whether or not parents want to circumcise their child is whether or not the father circumcised. And so, it's really just comforting for the father to have a son whose penis looks like his own. But in terms of medical eth medically or ethically it it it violates all more or less agreed upon premises that you shouldn't operate on healthy children.

73:07My my my father was not circumcised, but all of our all my brothers and myself was.

73:14And you know, I didn't get a saying that. And that's and the older I got, the more I thought about it, the more it angered me. And um uh yeah, there's and there's nothing.

73:27And so it are there. So So it it definitely impacts your sexual experience, right, in a negative way.

73:37um and there's no medical benefit to it ex and are there psychological damage done from having a being circumcised?

73:47>> Well, an easier way to look at it and the answer is absolutely yes, right? But the easier way to look at it is let's say you have two puppies from the same litter and one puppy you love and you care for and the other you abuse and you hit and you you know when they're those puppies are adults, they may look the same but they're not going to interact with the world the same. one is going to be a lot more defensive and apprehensive and potentially aggressive because of that violence. And the what we're talking about is some of the most extreme medieval torture that you can imagine on an infant, right? And there's

74:19actually studies that show that the way these infants respond to pain 6 months later after being circumcised is substantially different and more intense. So, there was a study of um recently circumcised newborn baby boys versus non-ircumcised boys and and females. And what they found is that those who were circumcised 6 months later when they had a vaccine, they had far more intense reactions to the moderate pain of a vaccine. And what that suggests is that the way that the brain is responding to pain has changed uh at least for 6 months and likely permanently at that plastic of of a stage. But when you actually talk about

75:01the procedure, right, we use euphemisms like circumcision, but what they do is they they restrain the baby, right? you know, >> straps here, straps here, straps on their legs with their genitals exposed, and then these medical professionals in quotes, >> they rub this iodine solution on the little penis to make it erect. So, they're stimulating the baby's genitals so it gets bigger and easier to grab.

75:24Then, they take a blunt probe, right?

75:26And they they jam it between the head of the penis and the foreskin, which is fused, as fused as my nails are to my fingers. So they tear those structures apart because they're supposed to be fused for 5 10 15 years because you're not using that body part until you know adolescence puberty when you're starting to quote unquote reproduce. So it's supposed to be fused. They tear that fusion like tearing fingernails and then they put a metal bell over the red raw exposed glands of the penis and then there's this contraption where they crush the foreskin after they put the detached foreskin over it with 10,000

76:03pounds of force. And this is we know there's there's been numerous studies hisystological studies studies of the anatomy that this is the most nerve dense part of the male body where pleasure is supposed to be received and you are torturing and mutilating this infant for five or 10 minutes and some of them have screamed so loud that they've burst their lungs and stomachs.

76:26I mean, this is truly one of the most painful things that could be imagined and we're doing it to infants on a mass scale in this country. It is it is an epidemic and it needs to stop and the rest of the world has moved away from it and we are moving away from it. We just need to move away quicker.

76:45>> It's, you know, I never really thought about it how they did it. I thought it was just like snip real fast. It was over and the baby cried a little and >> I didn't know that they restrained the like that. That seems uh like Epstein-like kind of torture for a baby.

77:01That just seems that is monstrous, is it not? How how does how can doctors, you know, do this? It just seems crazy to me. Do have you talked to doctors who've changed their mind about it after doing it?

77:13>> I do. There was a really famous one called Paul Fice. He was known as the ped pediatrician to the stars. He passed away not too long ago. And he said, you know, when he did circumcisions for maybe the first 20 years of his career, he didn't hear the baby's screams until he finally heard them and then he could not unhear them. And I think when you're in medical school, it's a very mercenary type uh mentality, right? You do what you're told and you know, if the baby's screaming, you know, he can't articulate his pain or cries or they're being fussy. It's just they compartmentalize it. But, you know, a lot of medical

77:53professionals now are are taking a conscientious objectors because it's indefensible. But, yeah, I mean, doctors, medical students, they do what they're told and it's a very hierarchal structure there. Um, I wouldn't do it, but I never went to med school. Right.

78:10Um, >> yeah, I Yeah, I know. I never went to So, you are now you're pursuing multi-state lawsuits. How's that going?

78:18Well, our first lawsuit in Oregon is going well. Um, we've So, essentially, these are constitutional challenges, right? Because everyone's heard of equal protection under the law. You can't give one race or sex certain statutory protections that you don't extend to everyone. Everyone needs to be equally protected. So, 41 of 50 states have a state law that says female genital cutting, female circumcision is illegal, right? It is outlawed. and that is great. But if you're going to pass a statute that only protects one sex, it's likely violating the equal protection provision of the constitution. And so Oregon has a

79:00express amendment to its constitution called the equal rights amendment where you are prohibited from discriminating on the basis of sex for various state laws. And so our argument is the anti-FGM law discriminates on the basis of sex in violation of the Oregon Constitution and as such the judge needs to either strike the law or expand it to protect all children equally. And um the judge seemed receptive to that argument.

79:27We overcame the motion to dismiss in Portland, Oregon. We had a full courtroom because the community is really behind us. that actually overflowed into the bar and uh the Oregon Department of Justice who was assigned to defend the law assigned five female attorneys. Now, that can't be by chance, but um but we beat all five of them and now we're moving towards a trial on judge a trial on the merits, which I anticipate we will prevail on because it seems pretty straightforward that the anti-female genital mutilation law discriminates on the basis of sex.

79:58Um so, the Oregon lawsuit's going great.

80:00We're about to file a Colorado lawsuit in the next few weeks. I'm looking for Colorado local council and uh if we raise more money and I'll sue every state in the nation, but um you know, I can only move as fast as we can move.

80:13There was very high caliber lawyering in Oregon. I felt really good about the pleadings and the research and we prevailed. So that's great. But um to do that level of that that caliber of legal work over and over and over again for each state, it requires a substantial amount of resources. And you know I I get lawyers like myself and others who are sympathetic to the movement, but it's still expensive to do. So um we do what we can.

80:39>> Why did Harvard get why did Harvard dis what what do they care about circumcision? What's what's their dog in this fight?

80:47>> Well, they care about PR and donations, right? very craven in that way. And so um they said they have no dog in the fight and you can give you a circumcision presentation. We won't retaliate against you. I worked for Harvard for eight years on and off on a physics textbook. Um, despite the evidence to the contrary, some people think that it's harmless. Some people think it looks better, right? Oh, well, I prefer cut penises. It's like, well,

83:52you know, if you have a penis, you can trim it however you want, right? But we're not tattooing our children or, you know, doing other body modifications.

84:01And in fact, those are expressly illegal, right? So, um, >> so are you, what kind of push back? I mean, you're you're uh you're Jewish. Do uh do you get push back from Jewish organizations? Do they have they tried to uh smear you?

84:20>> No, the only push back I really got was was after the Harvard I was like front page news for like two weeks, which is kind of cool at Harvard. They really really sought to destroy me. Um but uh you know recently uh none at all because right now the legal challenges well one I'm I've definitely I've definitely cooled down as time has progressed and you know I've developed in various ways but um uh currently we're not even addressing religious genital cutting.

84:51It's purely genital cutting in a medical context. And the reason for that is very legal in that if you are going to uh mutilate your son's genitals because your god tells you that is arguably covered under a different constitutional provision, the free exercise of religion provision, right? And that has a whole different jurisprudence and different rules that apply to it as opposed to the equal protection provision which we're focusing on because if you are cutting the genitals of a minor in a medical setting, there's no free exercise religion or free exercise constitutional considerations. So, we could sidestep

85:32the entire religious conversation and just focus on the secular genital cutting, which is at least 85% of circumcisions in the US. So, you know, this is a step-by-step process.

85:45When I was younger, I was a little more idealistic and that we could just make genital cutting illegal across the board. But now that I'm a little closer to how the sausage is made, so to speak, and how progress is made, um the most pragmatic and achievable step is to just address the secular genital cutting at first.

86:07>> Uh so what what are there stem cells involved? Do they extract stem cells?

86:17Well, the foreskin of a baby boy is the only body part that you can legally harvest, right? And it's the only body part that anyone can perform surgery on, even if they have no medical credentials. So, there's this weird exception for the most one of the most important parts of the male body that anyone can uh perform surgery or mutilate it, right? And so the same with the actual tissue from the infant male that that foreskin is valuable because it comes from it's it's neonatal tissue, right? So it has more stem cells. It's like less likely to have disease. It's the only body part you can legally

86:57harvest. And so what biomedical companies do is they they buy this tissue as you know after they circumcise the child which al also gives the hospital an improper incentive for this unnecessary and harmful procedure. But there's a there's a market for these biomedical companies to take this tissue and extract these skin cells and other stem cells and put them in various uh cosmetic and medical products. And this is a multi-billion dollar a year industry. So there's a major major moving force commercially to continue to mutilate our baby's sex organs.

87:36>> So is but parents at the end of the day they get to decide. The mother decides, right?

87:44>> Well, in some states I think it's both parents have to decide. But you know if you're a parent you don't get to decide what tattoos your child gets or how many fingers they get to keep. Right. So right >> we already have an incredible list of laws and norms where we restrict uh parental decisions when they are you know beyond what we would accept as a society and it is not unreasonable in my opinion and what all my advocacy is for is to restrict that from having a parent perform a prophylactic amputation on a functional sex organ. Right. Um and actually the Danes tried to make it illegal and Iceland tried to make it

88:24illegal and America came in at the behest of Israel and threatened them with economic sanctions and made you know put enormous political pressure on them. So >> why do they care? I don't understand.

88:38>> Well, I think it's uh I think it's probably Holocaust trauma. It's like, oh well, if they if we stop cutting our babies, then they're going to come for us next. And you know, it has nothing to do with that. It's about protecting children. And so that could be one of the reasons. Um, also if we start restricting medical genital cutting, then you know there'll be more scrutiny on religious genital mutilation. So it's it's kind of the slippery slope argument from the religious side is what I would imagine. Um, they don't really engage with me very much because they wouldn't, you know, farewell, right? And so

89:13most progenital cutting interest groups aren't really uh public in their advocacy because it's a very unpopular position.
